Terms and Conditions

A valid purchase order must be included on the sample submission form or full payment before results are returned.

 

FREIGHT – All freight charges for sample shipment, product shipment, and return of data will be paid by the customer. Data will be shipped by UPS 2-day express at a cost of $35/per package or overnight (UPS or FedEx) express mail at a cost of $60/package (or by weight for larger packages) unless otherwise specified by customer.

 

PAYMENT – Payment in full shall be made to MtoZ within 30 days of the invoice date. Payments not received within such 30-day period shall bear interest at the rate of 1.0% per month (12% per year) but not in excess of the maximum amount permitted under applicable law.

 

WARRANTY – MtoZ products are warranted to conform to the specifications appearing on the product labels, or for dated products, until the date appearing on such label. M-to-Z warranty obligation is limited to replacement of the defective product or the refund of the purchase price, at the option of M-to-Z. The foregoing warranty is the only applicable warranty. All other warranties, expressed or implied, including but not limited to, the implied warranty of merchantability or fitness for any particular purpose are disclaimed.

 

LIMITATION OF LIABILITY – MtoZ will accept limited liability for defective samples as determined by MtoZ to be defective. MtoZ liability shall not include the costs of preparing the new samples or the costs incurred in preparing the original samples. MtoZ liability shall be limited, in any event, to re-running defective samples at the company’s expense, excluding any cost of shipment if fresh samples are required.

 

It is understood and agreed that M-to-Z liability whether in contract, in tort, under any warranty, in negligence or otherwise shall not exceed the return of the amount of purchase price paid by the purchaser and under no circumstances shall MtoZ be liable for special, indirect or consequential damages.
